Event Terms & Conditions

Tickets Sales and Participation

1. Lowe & Co Foundation organises and hosts Open Wellington Home and Garden Tours (Open Wellington).

​

2. By purchasing a ticket(s) to participate in Open Wellington (“the Tour goer” or “I” or “my” or “me”) acknowledge and agree that these terms and conditions (“Terms”) apply to my ticket purchase(s) and participation in the Tours and acknowledge that these terms and conditions may be subject to change from time to time at the discretion of Lowe & Co Foundation without notice to the Tour goer.

Agreement Waiver and Indemnity

3. I declare that I am not aware of any illness, injury, physical disability or impairment which may cause me injury or death during or as a consequence of my attending Open Wellington.

​

4. The decision to attend Open Wellington is entirely my own and I accept all risks associated with my attending Open Wellington (including but not limited to), loss of life or permanent injury. I agree to accept full responsibility to inform myself and assess all the dangers, hazards and risks of attending the Open Wellington, and rely solely on my own assessment of these dangers, hazards and risks before attending the Open Wellington and notwithstanding any decision made by the Open Wellington organisers and other persons, corporations and bodies involved, engaged in promoting or staging Open Wellington. The following describe some, but not all, of the inherent risks of taking part in Open Wellington, including:

(a) Uneven ground or surfaces within homes and gardens on the Tour, as well as ruts, steps, holes, rocks or other conditions may exist in and around Open Wellington.

 

(b) Personal health and participation risk: The risk of contracting communicable disease(s) from other person(s) including, but not limited to, other Open Wellington goers; Lowe & Co Foundation volunteers or contractors; and/or any other person(s) before, during, and/or after Open Wellington and other activities.

 

(c) Supervision and activities risk: I understand that Lowe & Co Foundation, representatives, volunteers, contractors (or anyone associated with them) will be actively supervising Tour goers during the activities or at any time. Tour goers agree that they are solely responsible for their own well-being at all times.

 

(d) Equipment risk: The risk that equipment used on Open Wellington may be misused, or may break, fail or malfunction.

5. To the fullest extent permitted by law, I release all persons or corporations associated directly or indirectly with the Tours from all claims, demands and proceedings arising out of my attending and I hereby indemnify such persons or corporations against all liability, loss or damage arising out of my attending the Tours, including any breach of these terms and conditions by me. This liability, loss or damage includes, but is not limited to, the cost to defend or settle any claim, suit, action or proceeding brought against Lowe& Co Foundation. This release extends to and includes Lowe & Co Foundation, Lowe & Co, Wellington City Mission and their respective directors, officers, agents, contractors, employees, promoters, sponsors and volunteers, including medical and paramedical personnel appointed for open Wellington, the owners, licensees and occupiers of land upon which Open Wellington or any part of it takes place, any statutory body or local authority having control over any land upon which the Open Wellington or any part of it takes place or which is involved directly or indirectly with Open Wellington in any manner whatsoever. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.

6. I agree that agree as a ticketholder that I am directly liable for any damage or loss I cause to the Open Wellington tour property/ies, contents, land or home during the event, regardless of whether the damage was intentional or accidental.

​

7. All conditions and warranties which may be implied by law into these terms and conditions are excluded except to the extent that it would be unlawful to do so.

 

Open Wellington Tour Rules and Regulations

8. Tickets for the Tours are subject to availability and are available on a first come first served basis. Tickets can be purchased from www.openwellington.nz

​

9. I understand that Lowe & Co Foundation reserves the right to change or modify any part of the Open Wellington including the date or location at any time, Details of any such changes will be published via the Open Wellington website, Tours e-newsletters and/or other means. Lowe & Co Foundation will not be responsible for any costs incurred as a result of Open Wellington being modified. This includes but is not limited to ticket holders travel and accommodation to attend the event.

10. I acknowledge that Lowe & Co Foundation its representatives (including volunteers) may remove me from the Open Tours and/or exclude me from entering any of the houses if:

(a) my behaviour is inappropriate, offensive, or abusive;

(b) to prevent damage to any property;

(c) if the home owner reasonably requests;

(d) On medical or health and safety grounds (including to prevent possible harm or injury to myself or any other person); or

(e) to prevent or arrest any form of unauthorised marketing, including ambush marketing.

10. As I will be visiting people’s homes as part of Open Wellington, I will need to be respectful and adhere to all instructions from event staff and volunteers. Lowe & Co Foundation reserves the right to remove any Open Wellington Tour goers who do not adhere to instructions from volunteers or staff members on the day. It may be a condition of entry to some of the homes that make up the Open Wellington Tour that a search of a person and / or their possessions will be required at the time of the entry and / or exit.

11. Tour tickets may not, without the prior written consent of Lowe&Co Foundation, be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original purchaser or any subsequent bearer. If a ticket(s) is sold or used in breach of this condition, the ticket(s) may be cancelled without a refund and the bearer of the ticket(s) may be refused admission.

12. I agree to abide by all Open Wellington Tour rules, terms and conditions.

 

Traffic

13. I understand that I must observe normal traffic rules and parking rules and obey all directions and instructions given by Open Wellington Tour officials, event staff and volunteers. Event organisers are unable to provide carparking for the event. On street carparking parking is required at most properties, is limited and comes on a first come first served basis. Open Wellington attendees are encouraged to car pool on the day to help reduce traffic.

 

Cancellation

14. The Open Wellington Tour organisers reserve the right in their discretion to reject or cancel my attendance at any time, including without limitation for safety or insurance reasons. Lowe & Co Foundation will not be obliged to refund any portion of the ticket price in such circumstances.

 

Difficulties accommodating wheelchairs/ prams etc.

15. Due to the design of many heritage and private homes, accessibility for wheelchairs, mobility aids, walkers, and prams is limited or may be unavailable, both to the properties and/or inside the homes due to the design of those homes and the need to prevent injury to ticket holders and/or damage to Open Wellington Homes. Please contact us in advance if you require assistance or to discuss specific property access.

 

No Shoes to be worn inside

16. I understand that no shoes must be worn inside the houses.

 

No Food or Drink on Tour Properties

17. I understand that food or drink is strictly prohibited inside any of the private homes or gardens on the Open Wellington tour. This includes water bottles, takeaway coffee cups, snacks, or any other consumables. This rule is in place to respect the homeowners' properties and to prevent spills, stains, or accidental damage. I agree to dispose of any food or drink before entering a property and understand that failure to comply may result in removal from the tour.

 

No Dogs or other animals

18. Due to the personal nature of the private homes, no animals are permitted to accompany you on the tour, with the exception of registered service animals. Please contact us in advance of ticket purchase if this applies to you. Please note there may be some private properties that are unable to accommodate service dogs due to the individual circumstances of the owner.

 

No Photographs, videos or drones

19. I understand that taking photos inside the homes, the flying of drones and unmanned aerial vehicles (UAVs) by Tour goers is strictly prohibited.

 

No Smoking or vaping

20. I understand that smoking and/or vaping is strictly prohibited anywhere on the tour properties (both inside and out).

 

Toilets

21. Toilets are unavailable for use by ticketholders at the Open Wellington properties. Ticketholders are directed to public toilets. Location of public toilets will be provided in the Open Wellington map.

Consent to Medical Assistance

22. I consent to receive such medical aid or preventative treatment which may be deemed advisable in the unfettered direction of the Open Wellington medical officials in the event of any injury, accident or illness to me during my attendance of Tours.

​

23. I consent to the release of my personal information to medical assistance personnel and Open Wellington organisers in the event of a medical emergency during my attendance at the Open Wellington.

 

Tour Entry, Refunds and Promotional Codes

24. I understand that, as a general rule, ticket purchases are non-refundable and cannot be exchanged. No refunds will be issued for any tickets, subscriptions, donations or merchandise purchases, including where the Event is cancelled for any reason, except as required by law. Lowe & Co Foundation will not be responsible for any costs incurred as a result of the Event being cancelled or rescheduled.

​

A change in personal circumstances does not entitle a ticket holder to a refund on any ticket(s). Transaction fees, including but not limited to credit card fees and service fees, are also non-refundable.

Ticket(s) are able to be transferred to a family member or friend. In this instance, it is the responsibility of the ticket purchaser to change the name(s) on the ticket(s) via their booking account by 5.00pm on the Wednesday before the Tour date. The name(s) on the ticket(s) must match the name on the Open Wellington Tour goers’ photo ID which they must show at their starting house on the day of the Tour.

​

25. I understand that should my contact details change after my ticket purchase is completed, it is my responsibility to update this on my booking account no later than one week prior to the tour.

​

26. I understand that entry may be refused if tickets are damaged or defaced in any way, or are not purchased via the Open Wellington ticketing website.

​

27. I understand that entry may be refused if I do not have an acceptable photo ID (printed or digital) that matches the name on my ticket i.e. passport or drivers licence.

​

28. I understand that it may be a condition of entry that a search of a person and/or their possessions is required at the time of entry into the houses.

​

29. Should the scheduled Tour dates be impacted by government imposed restrictions, the Lowe & Co Foundation will endeavour to reschedule Open Wellington to new dates. All Open Wellington tour goers will automatically be transferred to new Open Wellington dates, with the option to opt-out.

​

Consent to Media Coverage of Event

30. I consent to the collection, publication and/or use in any form of media whatsoever of my name, image, video, voice, statement or otherwise, (including the publication of my name in any Lowe & Co Foundation, Lowe & Co and/or Wellington City Mission publication both online and in print and/or on the Open Wellington website for promotional, marketing or other purposes, without payment or compensation.

Booking Form and Personal Information

31. I declare that all the information supplied by me on the Open Wellington try booking form at point of sale is true and correct.

​

32. I consent to the Lowe & Co Foundation entering my personal details contained on the Open Wellington booking form from www.trybooking.com into the Open Wellington database, which will be used for the administration of the Tours.

​

33. Lowe & Co Foundation collects personal information to manage participation in Open Wellington. Unless indicated otherwise, I agree that may disclose my personal information to the Lowe & Co Foundation related companies, business units and departments, including but not limited to the Open Wellington event partners and sponsors, and may use the information for marketing future events, and other marketing and promotional purposes, including contacting Open Wellington goers to offer products and services of potential interest to me.

34. I have read and consent to the terms of the Lowe & Co Foundation’s Privacy Policy

35. I understand that I can gain access to my personal information and request that such details be updated if they change in the future by writing to office@loweandcofoundation.nz

​

36. Ticket purchasers who submit a booking form on behalf of their guests undertake to make each guest aware of these terms and conditions. Lowe & Co Foundation reserves the right to cancel any ticket purchase(s) at any time for any reason including, but not limited to, the ticket purchaser not having the requisite authority to purchase a ticket on behalf of their guest.

 

Age Declaration

37. I certify that I am 12 years or older, or that I am the parent/legal guardian of the accompanied Tour goer who is under the age of 18 years (but over 12 years), and I have read this document and fully understand it. As a parent or legal guardian, I agree to these terms and conditions for and on behalf of the Tour goer.

Regrettably, Children under the age of 12 years of age, including babies and toddlers, are not permitted to attend the Tours under any circumstance.

 

Cancellation and Rescheduling of Event

38. I understand that Lowe & Co Foundation reserves the unfettered right to cancel the Tours at any time. Reasons for cancellation may include, but are not limited to, Lowe & Co Foundation deciding in its sole discretion cancellation is required due to any sort of dangerous conditions and/or force majeure event (which may include, without limitation, war, civil disturbance, acts of God, epidemic or pandemic).

​

39. In the event of cancellation, a ticket(s) refund may be applied at Lowe & Co Foundations discretion and the cancelled Open Wellington may not necessarily be rescheduled. Where possible, a decision will be made about a rescheduled date and communicated to Open Wellington goers.

​

40. Lowe & Co Foundation will not be responsible for any costs incurred as a result of Open Wellington being cancelled or rescheduled.
